Terms of Service

These terms are an agreement between you and GhostEngine LLC, a Wyoming limited liability company ("GhostEngine", "we", "us"). They cover the Frogpost Chrome extension, our server, the phone page and frogpost.app ("Frogpost"). By installing or using Frogpost, you agree to them.

1. Using Frogpost

You must be 18 or older and able to form a binding contract. If you use Frogpost on behalf of an organization, you accept these terms for it. Frogpost has no accounts: your license key identifies your install and plan. Keep it private, because anyone with it can use your Pro plan and read your synced library.

Frogpost works on websites we don't control, such as Claude, ChatGPT, Gemini and Gmail, and their changes can break a grab or a drop until we update Frogpost. Features, supported sites and limits (including the free daily allowance of hosted handoffs) may change.

2. AI output

Handoffs are written by AI: your own provider, Chrome's built-in AI, the chat's own agent in ask mode, or Anthropic through our server. AI output can be inaccurate or incomplete, and it can present something as done when it wasn't verified. Frogpost is designed to keep your rules word for word and to separate verified work from claims, but it can't guarantee either. Review every handoff before you use it or pass it on. Don't rely on Frogpost as the sole basis for medical, legal, financial, safety-critical or other consequential decisions.

3. Your content

You own the chats you grab and the handoffs made from them. You give us only the limited permission needed to process them to provide Frogpost to you, as described in the Privacy Policy. You're responsible for having the right to grab and process that content. That includes other people's messages and personal data in a chat or email, and the terms of the site you grab from. If you send us feedback, we may use it without obligation to you.

4. Acceptable use

Don't use Frogpost to:

• break the law or anyone's rights, including privacy and intellectual property;
• generate content that violates Anthropic's Usage Policy through our hosted service;
• get around limits or payment, for example by generating license keys or rotating IP addresses for more free handoffs, or by sharing a Pro license outside your own use;
• probe, overload, scrape or reverse engineer our server, or use it to build a competing service;
• send spam or post on someone's behalf without their consent.

We may suspend or end access that breaks these terms or puts Frogpost, its users or others at risk.

5. Other services

If you add your own Anthropic or OpenAI API key, your use of it is governed by your agreement with that provider, and you pay its charges. Frogpost isn't affiliated with or endorsed by the sites it works on. Their names are trademarks of their owners.

6. Pro, rare frogs and billing

• Billing. Stripe processes all payments. Pro is billed monthly in advance at the price shown at checkout, plus applicable taxes.
• Free trial. If you start a trial, you're charged when it ends unless you cancel before then.
• Renewal and cancellation. Pro renews automatically each month. Cancel any time with Manage billing on Frogpost's Settings page. You keep Pro until the end of the period you've paid for.
• Refunds. Payments are non-refundable, and we don't refund partial months, except where the law requires it. If something went wrong, email us and we'll look at it.
• Rare frogs are one-time purchases tied to your license key. They have no cash value and can't be transferred. Pro includes every rare frog while it's active.
• EU and UK consumers. You ask us to start your Pro subscription or deliver a rare frog immediately. To the extent the law allows, you acknowledge that you lose your 14-day right of withdrawal once it has been provided.
• Price changes take effect at your next billing period after notice, and you can cancel before then.
• Lost license key. Email us from the address you paid with and we'll find it.

7. Our rights

Frogpost, including its software, frog models, artwork and name, belongs to GhostEngine or its licensors. Some parts are third-party works used under their licenses and credited in the files that ship with the extension. We give you a personal, revocable, non-exclusive, non-transferable license to use Frogpost under these terms.

8. Disclaimers

Frogpost is provided "as is" and "as available". To the fullest extent permitted by law, GhostEngine disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement. We don't warrant that Frogpost will be uninterrupted or error-free, that a grab will capture every message, that AI output will be accurate, or that stored data will never be lost. Keep your own copies of anything important.

9. Limitation of liability

To the fullest extent permitted by law, GhostEngine will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, data or goodwill, arising out of or relating to Frogpost or these terms, even if advised of their possibility. GhostEngine's total liability for all claims is limited to the greater of the amount you paid us in the 12 months before the claim and US$50.

Some jurisdictions don't allow these limits, so they may not fully apply to you. Nothing in these terms limits liability that can't be limited by law, such as for fraud or for death or personal injury caused by negligence. Nothing in them limits consumer rights you can't waive.

10. Indemnity

To the extent the law allows, you'll defend and indemnify GhostEngine against third-party claims, losses and reasonable legal fees arising from your content, your use of Frogpost in breach of these terms, or your violation of law or anyone's rights.

11. Disputes and arbitration (United States)

Email zoltan@frogpost.app first. Most issues can be fixed informally, and we'll try for 60 days before either side starts a formal proceeding.

If that fails, you and GhostEngine agree to resolve any dispute arising out of or relating to Frogpost or these terms by binding individual arbitration. The American Arbitration Association administers it under its Consumer Arbitration Rules. The hearing can be held by video or in the county where you live, or else in Wyoming. Two exceptions: either side may bring an individual claim in small claims court, or seek an injunction in court for misuse of intellectual property. The Federal Arbitration Act governs this section.

You and GhostEngine each waive the right to a jury trial and to take part in any class, collective or representative proceeding. If this waiver is found unenforceable for a claim, that claim goes to court instead of arbitration.

You can opt out of this section by emailing us within 30 days of first accepting these terms. It doesn't apply if you live in the EEA, the UK or Switzerland. There, you can bring claims in your local courts, and your local consumer protection law applies.

12. Governing law

These terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules, except where your local consumer law requires otherwise. Subject to section 11, disputes go to the state or federal courts in Wyoming.

13. Ending

You can stop at any time by uninstalling Frogpost and cancelling Pro. We may discontinue Frogpost or any part of it. If we end a paid feature before the end of a period you've paid for, we'll refund the unused part. Sections 2, 3 and 7 to 14 survive.

14. General

We may update these terms. We'll change the date at the top, and for a material change we'll give notice before it takes effect, for example in the extension. If you keep using Frogpost after that, you accept the update. These terms and the Privacy Policy are the entire agreement between us about Frogpost. If any part is unenforceable, the rest stays in effect, and not enforcing a part isn't a waiver. You may not assign these terms. We may assign them along with the business.
